1. Acceptance of Terms

By accessing and using PatentClock, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our service.

2. Description of Service

PatentClock provides patent expiration tracking services, including:

  • Patent information lookup via USPTO public databases
  • Expiration date calculations
  • Watchlist management (paid plans)
  • Email alerts for upcoming expirations (paid plans)

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Subscription Plans

We offer Free, Starter, Pro, and Firm subscription plans with different features and limits:

  • Free: 10 lookups per month, no watchlist
  • Starter ($29/mo): Unlimited lookups, 25 watchlist patents
  • Pro ($79/mo): Unlimited lookups, 200 watchlist patents, bulk upload
  • Firm ($199/mo): Unlimited lookups, unlimited watchlist, priority support

Subscriptions renew automatically each month until cancelled. You can cancel anytime through your account settings or the Stripe customer portal.

5. Refunds

Subscription fees are non-refundable except where required by law. When you cancel your subscription, you will retain access to paid features until the end of your current billing period.

6. Data Accuracy Disclaimer

IMPORTANT: PatentClock provides patent expiration estimates based on publicly available data from the USPTO. These calculations are provided for informational purposes only and should not be relied upon as legal advice or as definitive expiration dates.

Patent expiration dates can be affected by various factors including:

  • Patent Term Adjustments (PTA)
  • Patent Term Extensions (PTE)
  • Terminal disclaimers
  • Maintenance fee payment status
  • Legal proceedings

You should always verify expiration dates with the USPTO or consult a patent attorney for critical deadlines. We are not liable for any decisions made based on our calculations.

7. Intellectual Property

The PatentClock service, including its design, features, and software, is owned by us and protected by copyright and other intellectual property laws. USPTO patent data is public domain.

8. Prohibited Uses

You may not:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Scrape, harvest, or collect data using automated means
  • Resell or redistribute our services without permission
  • Violate any applicable laws or regulations

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATENTCLOCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless PatentClock from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason. You may terminate your account at any time through your settings.

13. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the service. Continued use of the service after changes constitutes acceptance.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States and the state in which our company is registered, without regard to conflict of law principles.
